TRADEMARK GUIDELINES

1. GENERAL GUIDELINES. USA.NET considers its trademarks to be among its most valuable assets. USA.NET "trademarks" as used in these Trademark Guidelines include all domain names, logos, taglines, trademarks, and service marks of USA.NET, Inc. whether registered or unregistered. All other trademarks referenced on the USA.NET website located at www.usa.net, in USA.NET marketing collateral, or other material distributed by USA.NET, are the property of USA.NET or their respective owners.

USA.NET's trademarks may only be used under the terms set forth in these Trademark Guidelines; any other use requires written permission from USA.NET, Inc., obtained prior to use. Except as expressly specified in these Trademark Guidelines, nothing contained herein shall be construed as conferring to you any license or right under any proprietary rights of USA.NET or any third party.

In addition to the guidelines set forth herein, you may not use USA.NET trademarks in a disparaging or misleading manner, and you may not alter USA.NET trademarks. You may not adopt, use, or attempt to register, any other trademarks, words, symbols, letters, designs or marks (a) in combination with USA.NET's trademarks in a manner that would create combination marks, or (b) that would be confusingly similar to USA.NET's trademarks. USA.NET may amend these Trademark Guidelines from time to time and will post current guidelines at http://www.usa.net/legal/trademark-guidelines.asp. USA.NET reserves the right to revoke your right to use the USA.NET trademarks, in its sole discretion, as to any use that it finds objectionable.

2. TRADEMARK USE GUIDELINES. The following guidelines provide the only authorized use of USA.NET trademarks, unless otherwise authorized by USA.NET in writing prior to use:

PROMINENT USE

All USA.NET trademarks must be used prominently (by use of size, color, position, print style, raised letters) and should be the dominant word, symbol or device, if placed in text. The USA.NET trademarks must be used in a manner that clearly shows its trademark status.

 

PROMINENT IDENTIFICATION

All USA.NET trademarks must be identified as such by applying the appropriate trademark symbol. Please refer to the table of registered USA.NET trademarks below for information on use of the correct trademark symbol. The "®:", "™" or "^SM" symbol should be large enough to be easily spotted and should be placed as either a superscript or subscript immediately following the USA.NET trademark.

DISTINGUISH USA.NET TRADEMARKS

When using a USA.NET trademark in a printed material, the trademark must be distinguished from surrounding text and may appear in all capital letters, in quotation marks, underlined, italicized, or in boldface.

		"USA.NET"® eMessaging Services
	Incorrect use:	usa.net ® eMessaging Services
		Usa.net eMessaging Services

 

MARK USA.NET TRADEMARKS ON FIRST USE

At least the first use of a USA.NET trademark must use the appropriate trademark symbol and all subsequent uses must make its status as a trademark clear (for example, in all capital letters and in boldface, quotation marks or italics). In long works, repeat use of the appropriate trademark symbol periodically -- once every section, chapter or page.

 

USE OF MULTIPLE TRADEMARKS

When using two or more USA.NET trademarks in conjunction with one product or service, use the appropriate trademark symbol with each individual trademark, with at least a slight separation.

	Correct Use:	USA.NET® is recognized as The Global eMessaging Service Provider®.
	Incorrect Use:	USA.NET® The Global eMessaging Service Provider®.

 

USE TRADEMARK NOTICES

You must attribute ownership of USA.NET trademarks to USA.NET, Inc. The following notice must be displayed with your use of USA.NET trademarks:

	Correct Use:	"Net@ddress"® is a federally registered trademark of USA.NET, Inc.
	Incorrect Use:	Net@ddress is a federally registered trademark of USA.NET, Inc.

You may also reference such notices as small type at the bottom or end of advertisements, brochures, and other literature, as in the following example:

	eArmor® and Net@ddress® are registered trademarks of USA.NET, Inc.
	or
	eArmor® and Net@ddress® are registered trademarks of USA.NET, Inc. All other trademarks are the registered trademarks of their respective owners.

 

DO NOT USE USA.NET TRADEMARKS IN POSSESSIVE OR PLURAL FORM

USA.NET trademarks may not be used in the possessive or plural form.

	Correct Use:	The software was based upon an USA.NET® proprietary program.
	Incorrect Use:	The software was based upon USA.NET®'s proprietary programs.

 

USE USA.NET TRADEMARKS ONLY AS ADJECTIVES

Always use USA.NET trademarks as an adjective, never as a noun.

	Correct Use:	USA.NET® eMessaging services are the best!
	Incorrect Use:	USA.NET® is the best!

 

WEBSITE USE

You may reference a USA.NET service within text on your website, as long as such reference is consistent with the guidelines set forth herein. You may not establish a hyperlink to any USA.NET website without the express, prior written permission of USA.NET, Inc.

 

3. ADDITIONAL GUIDELINES

You may use USA.NET trademarks in promotional materials distributed by you under the terms set forth herein, so long as such use is solely to (a) identify you as an independent distributor of USA.NET products and services; (b) solicit sales of the USA.NET services; (c) identify USA.NET as the provider of such products and services; and (d) on your customer invoices for USA.NET services. Your use of the USA.NET trademarks, and any goodwill arising therefrom, will inure to USA.NET's sole benefit. USA.NET may monitor the quality of the services for which you will be using the USA.NET trademarks to ensure that they conform to the standards of quality of the USA.NET services. You shall not to adopt, use, or attempt to register any other trademarks, words, symbols, letters, designs or marks (i) in combination with the USA.NET trademarks in a manner that would create combination marks, or (ii) that would be confusingly similar to the USA.NET trademarks. You shall not seek or obtain any trademark or trade name registration embodying the USA.NET trademarks, nor register or cause to be registered, any USA.NET trademarks in your own name.

 

4. REVOCATION OF PERMISSION TO USE USA.NET TRADEMARKS

USA.NET reserves the right to revoke any use of the USA.NET trademark by you that USA.NET finds objectionable, and you shall stop using the USA.NET trademarks in such objectionable manner within two (2) days after the date USA.NET provides you with notice thereof.
