USA.NET Civil Subpoena Policy

USA.NET, Inc.’s Privacy Policy and User Terms and Conditions prohibit disclosure of information pertaining to a user and/or subscriber, including account information and the contents of electronic communications, to unaffiliated third parties, except as necessary to provide our services, as necessary to protect our website, users, and property, or as required by law. USA.NET will only disclose the minimum amount of information subject to a disclosure requirement.

In addition to USA.NET’s Privacy Policy, the Electronic Communications Privacy Act, 18 U.S.C. § 2701, et. seq., prohibits an electronic communications service provider from disclosing the contents of electronic communications, even pursuant to a subpoena or court order, except in certain limited circumstances.

To request information pertaining to a user and/or subscriber, including account information and the contents of electronic communications, you must serve USA.NET with a valid subpoena, search warrant, or court order through our registered agent:

USA.NET will promptly notify the subscriber and/or user of the request for information. In order to provide the user and/or subscriber an opportunity to move to quash the subpoena or seek similar protection from a court, USA.NET will not produce information subject to the request until a minimum of 10 business days following receipt of the request. USA.NET reserves the right to request any additional information relevant to the request for information and USA.NET may itself object to the request on any applicable grounds or as required by law.

USA.NET retains electronic communications on its servers for a limited amount of time. Following this period of time, it is impossible to recover retroactively electronic communications sent from, or received by, a specific account. Electronic communications on back-up tapes, if any, are a point-in-time snapshot of the contents of each mailbox at the time the back-up is performed.

USA.NET will charge a fee of $225 per hour for research and production of information pursuant to a request, with a half-hour minimum charge.
